EVICTION SERVICES 

When a tenant violates the terms of a lease or engages in unlawful behavior, landlords may initiate what’s commonly known as an eviction or unlawful detainer. These types of evictions apply to both residential and commercial properties and are governed by strict legal requirements under the law and local ordinances like the Just Cause Eviction Ordinance.

Common Grounds for At-Fault Just Cause Evictions Include:
  • Failure to pay rent
  • Engaging in criminal activity on the property
  • Violating a material term of the lease agreement
  • Illegal subletting or unauthorized assignment of the lease​

​While these are among the most frequent reasons for at-fault evictions, they are not an exhaustive list. Landlords may have additional valid legal grounds depending on the circumstances of the tenancy.

Why Landlords Need Help

Notice Types & Periods Answer/Response Deadline Default Judgment Lockout/Writ of Possession
New Mexico (NM) 3-day pay/quit; 7-day cure violation; 7-day quit for repeats; 30-day for month-to-month. Hearing 7-10 days post-summons; answer before hearing or risk default. Default if tenant fails to appear/answer. Request judgment and writ. Writ of restitution post-judgment; 3-7 days to vacate before enforcement.
