LEMON LAW

  • Refund: Full purchase price minus mileage offset from first repair.
  • Replacement: Comparable vehicle.
  • Plus attorney fees, incidental/consequential damages (e.g., towing, rentals).
For older vehicles, Truth in Lending Act may offer cash recovery.

​Filing Deadlines & Statute of Limitations: Actions must be brought within the warranty period or 1 year from delivery for presumption (per § 57-16A-8). General warranty breaches: 4 years under UCC (§ 55-2-725). No major 2025 changes noted

Motor Vehicle Quality Assurance Act
​(N.M. Stat. Ann. § 57-16A-1 to -9)

This act covers new and used passenger vehicles (cars, trucks, SUVs, motorcycles, vans under 10,000 lbs GVW) used for personal/family purposes. It requires manufacturers to fix defects and dealers to provide minimum warranties—no "as-is" sales allowed.

Eligibility & Covered Defects: Any defect substantially impairing use or market value qualifies, even minor ones under warranty (engines, transmissions, brakes, radio, climate control, suspension). For used cars: Dealer warranty of fitness for 15 days/500 miles (or up to 30 days/1,000 miles in some updates). Presumption of lemon: 4+ repair attempts or 30+ business days out of service, within 1 year or warranty period.
