Know Your Rights: Tenant Protections Against Evictions

Picture
As a tenant facing the threat of eviction, you have rights designed to protect your housing stability. We evaluate the eviction process from your perspective, current moratoriums in place, lingering COVID-19-related safeguards, and protections against increasing immigration-based discrimination. Remember you're not alone, reach out for help early to fight back and stay housed.

Quick Tip* Document everything: texts, emails, notices, and never ignore a landlord's communication. Looking to go at it alone? Don't forget free legal aid is always available and can make all the difference in your case.
Case Evaluation
Standing Strong in ABQ
Albuquerque has been strengthening its renter protections, making it harder for landlords to remove tenants without following proper legal steps. While New Mexico law doesn’t allow rent control, ABQ has adopted measures that prioritize stability, including strict notice requirements for evictions, protections against source-of-income discrimination, and new city efforts focused on transparency and fair treatment in rental applications. Recent local reforms, along with statewide habitability requirements, reflect a growing push to ensure tenants aren’t displaced without cause and have a fair chance to stay in their homes.
NM the Land of Enchantment
New Mexico's Uniform Owner-Resident Relations Act emphasizes fair treatment and court oversight for evictions. No broad statewide moratoriums are in effect but prevention programs and fee caps empower you to negotiate and avoid court.

The Eviction Process: What to Expect and How to Respond
New Mexico
  • Notice Period : 3 days for non-payment of rent; 7 days for other lease violations (chance to fix); immediate for serious safety threats. Always get notices in writing.
  • Court Hearing : Landlords must file in magistrate court—you'll get a summons and can file an answer to contest (e.g., prove payment or habitability issues). Mediation is often available. No lockouts without a judge's writ of restitution.
  • Your Defenses : Argue improper notice, retaliation, or unlivable conditions. Costs to fight: Low with free forms from nmcourts.gov.
Post COVID-19 Era
While most pandemic-era eviction moratoriums have expired in both Los Angeles and New Mexico, tenant-focused relief programs continue to address ongoing hardships tied to COVID-19 impacts. These protections emphasize prevention and financial support to keep you housed. Always apply early for the best outcomes.

  • In New Mexico : Statewide pauses ended, but general rental assistance remains available for COVID-linked hardships. The NM Eviction Prevention & Diversion (NMEPD) program connects you to lingering federal funds (usable until September 2025), prioritizing low-income and immigrant families.
